These terms and conditions apply to the use of this website at bamboorecycle.com. By accessing this website and/or placing an order, you agree to be bound by these terms and conditions.

Using this website indicates that you accept these terms regardless of whether or not you choose to register with us or sell to us.

INTRODUCTION

Our site is only intended for use by people registered with us and resident in Great Britain and Northern Ireland. At our complete discretion we may accept or reject orders from people outside of these areas.

You will be able to access most areas of this Website without registering your details with us. Certain areas of this Website are only open to you if you register with us. We may revise these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the then current terms and conditions. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website.

SELLING YOUR MOBILE PHONE

When placing an order via our online checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the mobile phone(s)/device(s) you have agreed to sell. We will send you a confirmation by email once we have received your phone(s). We may refuse to accept an offer of supply: if there has been a pricing or product description error; or if you do not meet any eligibility criteria set out in our terms and conditions.

CONTRACT CANCELLATIONS AND COOLING OFF PERIOD

The law (in some cases) gives a right to cancel an agreement any time within 7 days beginning on the day after an agreement is formed or until the services begin, whichever comes first. This is known as the "cooling off period". Once your sales order has been placed online and we have sent you the confirmation you will then have 7 days from that date to cancel only if we have not begun our services, you agree that your 'cooling off' right will end at this time. We will start the process of our services to fulfil our agreement when we receive your mobile phone/device you hereby agree that we may begin work straight away in order to deal with your mobile phone/device. Therefore we will not return your mobile phone/device and you will not be able to cancel the agreement once we have received your mobile phone/device, except as it is laid out in these terms and conditions. By sending in your mobile phone/device you are agreeing that we may begin work as soon as we receive your mobile phone/device which may affect your cancellation rights, and your 'cooling off' rights will no longer apply we will also not be able to return your mobile phone/device.

We will however return your mobile phone/device if, when it arrives with us, we find that it has a lesser value than originally stated, so much so that we revise the value and you confirm that you no longer wish to sell your mobile phone/device. In this instance you will have 3 days to respond to our email with the stated revised offer. Other circumstances for cancellation are in accordance with these terms.

To exercise your 'cooling off' rights you will need to do so in writing (either via letter or email). You must state that you want to evoke your 7 day cooling off right, which is stated above. If you inform us in writing that you no longer wish to send your mobile phone/device we will remove your sales order from our system you will then be removed from our reminder system as well as our order system. In these circumstances you will not be entitled to any payment from us in anyway.

PRICING

Please be aware that we only pay for mobile phones/devices listed on this website. Any obsolete mobiles received will be recycled accordingly.

All prices include VAT (where applicable) at the current rate. We reserve the right to change prices without notice, but all orders placed prior to a price change will be honored at the agreed price when the order is placed except when an obvious pricing error has occurred. Current ‘pending’ orders are valid for 14 days after the order has been placed. We will send you an email notifying you that your order has been accepted when we receive your mobile phone/device. If we receive your phone after this 14 day period we reserve the right to change the price of your phone/device to reflect the new price (either upwards or downwards) if prices have changed during this period.

We reserve the right to make revised offers on any mobile phone/device received which is different in make/model or Brand New / working / non-working condition as described on our website (this includes password or iCloud locked mobile phones/devices). These offers are made by email after the mobile phone/device is processed and need to be accepted within 3 days by email reply. If you decide to reject the offer within 3 days of our notification, we will return the mobile phone to you for a small postage charge if you chose to use the Freepost label, if however you chose to use your own postal method unfortunately we cannot cover the cost of this. If we do not receive your email reply of our revised offer within 3 days, revised offers will automatically preceded to payment. We will not be held liable if any payment is delayed because of no response received from the customer. Offer prices are subject to change.

For wholesale customers, revised offers will be made on the sale as a whole.

We will use our reasonable endeavors to provide our customers with the 'Best Price' for their mobile phone/device. However, this is not a guarantee. We shall not be held liable under any circumstances regarding price pledges.

TERMS AND CONDITIONS FOR MOBILE PHONES/DEVICES

BRAND NEW MOBILE PHONES/DEVICE(S)

Each Brand New mobile phone/device(s) must meet the following criteria:

  • Completely Unused
  • It must be a UK mobile Phone/device(s)
  • In Full Working Order
  • Full complete original manufacturer box in brand new condition
  • All original manufacturer accessories and manuals in brand new condition
  • The mobile phone/device(s) must not have any cosmetic marks/scratches
  • The IMEI Number on the box must match the internal and external IMEI number of the mobile phone/device(s)
  • All original manufacturer protectors attached (screen and device shell)
  • Must be a UK mobile phone/device(s)
  • All parts must be authentic official manufacturer

If the mobile phone/device(s) fails to meet the criteria set out under the ‘New’ condition it will be downgrade to either ‘Working’ or ‘Non-Working’ dependent on the test results.

WORKING MOBILE PHONES/DEVICE(S)

Each Working condition mobile phone/device(s) must meet the following criteria:

  • It must power on and off.
  • All standard functionality and software must be in working order.
  • It must be a UK mobile Phone/device(s)
  • It must be on a UK network
  • Must not be password locked
  • Must not be illegally unlocked
  • It must not be illegally unlocked
  • The internal IMEI number must match the external IMEI number
  • It must be complete with SIM tray
  • Be complete with battery and back cover
  • The integral bodywork should have no cracks, missing plastics / metal and there should be no missing buttons.
  • All buttons must function fully/correctly
  • The bodywork should not be hanging off the main body of the phone in any way.
  • The LCD must be working, power up correctly and fully beyond the network ‘Welcome Note’
  • The LCD must have no lines, missing pixels or discolorations
  • The screen must be intact with no cracks
  • No liquid damage
  • A white screen does not constitute a working phone.
  • If the phone has a touch screen the touch screen must be fully functional.
  • The stylus must be included if originally sold with the mobile phone/device(s)
  • Slider mechanisms must function correctly.
  • The phone must be fully working and fully functional.
  • All parts must be authentic official manufacturer

If the mobile phone/device(s) fails to meet the criteria set out under the ‘Working’ condition it will be downgrade to ‘Non-Working’ dependent on the test results.

NON-WORKING MOBILE PHONES/DEVICE(S)

If your mobile phone/device(s) does not comply with the New or Working conditions, it will be classified as Non-Working. Non-working mobile phone/device(s) should meet the following criteria:

  • It must be a UK mobile Phone/device(s)
  • It must be on a UK network
  • Must not be crushed.
  • Must not be broken in half or bent in any way.
  • No integral parts such as camera, LCD etc should be missing.
  • No integral parts should be detached from the main body of the phone in any way or be missing.

NEW APPLE IPHONES/DEVICE(S)

Each Brand New Apple Iphone/device(s) must meet the following criteria:

  • Completely Unused
  • It must be a UK Apple IPhone/device(s)
  • In Full Working Order
  • Full complete original Apple box in brand new condition
  • All original Apple accessories and manuals in brand new condition
  • The Iphone/device(s) must not have any cosmetic marks/scratches
  • The IMEI Number on the box must match the internal and external IMEI number of the Apple Iphone/device(s)
  • All original Apple protectors attached (screen and device shell)
  • Must be a UK Apple Iphone/device(s)
  • All parts must be authentic official manufacturer

If the Apple Iphone/device(s) fails to meet the criteria set out under the ‘New’ condition it will be downgrade to either ‘Working’ or ‘Non-Working’ dependent on the test results.

WORKING APPLE IPHONES /DEVICE(S)

Each Working condition Apple Iphone/device(s) must meet the following criteria:

  • It must power on and off.
  • It must be a UK Apple IPhone/device(s)
  • It must be on a UK network
  • Must not be ICloud/Find my IPhone locked
  • Must not be password locked
  • Must not be illegally unlocked
  • It must not be illegally unlocked
  • The internal IMEI number must match the external IMEI number
  • It must be complete with SIM tray
  • Be complete with battery and back cover
  • The integral bodywork should have no cracks, missing plastics / metal and there should be no missing buttons.
  • All buttons must function fully/correctly
  • The bodywork should not be hanging off the main body of the phone in any way.
  • The LCD must be working, power up correctly and fully beyond the network ‘Welcome Note’
  • The LCD must have no lines, missing pixels or discolorations
  • The screen must be intact with no cracks
  • No liquid damage
  • A white screen does not constitute a working phone.
  • If the phone has a touch screen the touch screen must be fully functional.
  • The stylus must be included if originally sold with the mobile phone/device(s)

If the mobile phone/device(s) fails to meet the criteria set out under the ‘Working’ condition it will be downgrade to ‘Non-Working’ dependent on the test results.

NON WORKING APPLE IPHONE/DEVICE(S)

If your Apple Iphone/device(s) does not comply with the New or Working conditions, it will be classified as Non-Working. Non-working Apple IPhone/device(s) should meet the following criteria:

  • It must be on a UK network
  • It must be a UK Apple IPhone/device(s)
  • It must not be illegally unlocked
  • It must not be crushed.
  • It must not be broken in half or bent in any way.
  • No integral parts such as buttons, camera, LCD etc should be missing.
  • No integral parts should be detached from the main body of the phone in any way or be missing.
  • All Apple IPhone/device(s) must have ALL components and buttons still attached to the handset.

If a mobile phone/device(s) fails to meet our terms and conditions we will change your order according to the condition or the model of mobile phone/device(s) that you have sent us. bamboorecycle.com reserves the right to reject any handset it does not deem acceptable.

STOLEN, BLACKLISTED OR BARRED MOBILE PHONES

IMPORTANT TERMS AND CONDITIONS RELATIING TO LOST, BLOCKED OR STOLEN MOBILE PHONES

We do not accept stolen, blacklisted or barred mobile phones/devices. We check all received phones/devices via www.checkmend.com a crime protection database, to ensure that the mobile phones have not been registered lost, blocked or stolen by the Police, Insurance Companies or Mobile Phone Networks.

If your mobile phone/device is found to be registered lost, blocked or stolen you will need to contact your Network provider and CheckMend if you wish to have it unblocked. You will be notified automatically by email of the process you will need to follow.

Any mobile phones/devices that are found to be registered lost, blocked or stolen will be quarantined for a period of 30 days. During this period if the block is removed the phone will be processed by bamboorecycle.com and the full original quoted price will be paid.

If the block is not removed within the quarantine period of 30 days and the phone has not been claimed by its rightful owner it will be destroyed.

If you feel the information held by CheckMend is incorrect please email CheckMend at support@checkmend.com with all the details including the IMEI number and they will assist you.

By submitting an order through our site you warrant that your mobile phone/device complies with these terms.

If a mobile phone/device fails to meet our terms and conditions we will change your order according to the condition or the model of mobile phone/device that you have sent us.

SIM CARDS AND MEMORY CARDS

We will endeavour to remove any SIM or Memory cards left in mobile phones/devices we receive and destroy them. We accept no liability or responsibility in the event that any mobile phone/device sent to us with its SIM card still inside the mobile phone/device incurs any charges. You shall continue to be responsible for any such charges.

You are responsible for cancelling any airtime contract linked to each mobile phone/device. We are not responsible for any call costs that may be incurred arising before, or after, receipt of your mobile phone/device, or arising from any other circumstances whatsoever. bamboorecycle.com reserves the right to reject any handset it does not deem acceptable.

POSTING YOUR MOBILE PHONE/DEVICE(S)

We recommend sending the mobile phone/device special delivery to the following address:

Special Delivery will insure your mobile phone/device up to a value of £500.

Or at greater risk by using the FREEPOST label attached to your trade pack letter. This is also the same address as stated above.

The FREEPOST jiffy bag that we send to you will comfortably fit a regular sized mobile phone and in some cases two mobile phones. If however your mobile phone/device does not fit in our jiffy bag comfortably we recommend that you send your mobile phone/device to us using alternative suitable packaging.

When sending New mobile phones/devices to us we recommend that not only do you use a secure tracked delivery service but that you also package your mobile phone/device in suitable packaging.

Bamboorecycle.com accepts no responsibility for any mobile phone/device that does not arrive via either postal method.

Please note that if you use the Freepost address to send your mobile phones it can take up to 5 - 7 working days to reach us.

DATA

Please note that it is your responsibility to remove data from your mobile phone/device before you send them to bamboorecycle.com. Such data includes, for example; personal details, SMS, photos, games, songs or any other data.

Please note that we do not accept any responsibility in relation to the security, protection, confidentiality or use of such data and it is your responsibility to ensure that such data is removed from your phone prior to sending it to us. Please see our FAQ for instructions on how to delete personal data from your mobile phone/device. By sending your mobile phone/device to us you agree to release us from all and any losses, claims or damages with respect to the data enclosed or stored therein or on any media used in conjunction with the device.

LICENCE

You are permitted to print and download extracts from this Website for your own use on the following basis:

no documents or related graphics on this Website are modified in any way;

no graphics on this Website are used separately from accompanying text; and

any of our copyright and trade mark notices and this permission notice appear in all copies.

Unless otherwise stated, the copyright and other intellectual property rights in all material on this Website (including without limitation photographs and graphical images) are owned by us or our licensors. For the purposes of these terms and conditions, any use of extracts from this Website for any purpose is prohibited. REGISTRATION

To register with bamboorecycle.com you must be over eighteen years of age. Each registration is for a single user only. We do not permit you to share your user name and password with any other person nor with multiple users on a network. Responsibility for the security of any passwords issued rests with you and if you know or suspect that someone else knows your password, you should contact us immediately on 0345 582 0511 We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions.

PAYMENT

bamboorecycle.com offer payment via Cheque or BAC'S.

Cheques will only be reissued in the instance that they have been lost in transit.

We can only re-issue cheques if we are notified by yourself via email/letter within 14 days of receiving the confirmation email stating that your cheque has been sent.

We will then re-issue the cheque within 14 working days from the date of your notification to us. Reissued cheques may be delayed due to bank administration.

Cheques are valid for 6 months.

BACS payments will be made on a working day after your mobile phone/device has successfully cleared the testing process, payment may take up to 2 working days to clear. If you choose BACS it is the responsibility of the customer to enter the correct account number and sort code. We use software to verify these account details, but bamboorecycle.com cannot take responsibility for account and sort codes that are input incorrectly. Please note that BACS payments cannot be reissued under any circumstances.

DISCLAIMER

While we endeavour to ensure that the information on this Website is correct, we do not warrant the accuracy and completeness of the material on this Website. We may make changes to the material on this Website, or to the products and prices described in it, at any time without notice. The material on this Website may be out of date, and we make no commitment to update such material.

The material on this Website is provided "as is" without any conditions, warranties or other terms of any kind. It is prohibited to access the Website from territories where its contents are illegal or unlawful. If you access this Website from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with local laws.

MISCELLANEOUS

You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions.

If any provision of these terms and conditions is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect.
